Obtain a Pollution Control Licence In Uganda By Online

  1. To apply for the pollution control licence or permit for pollution control in Uganda Contact NEMA. National Environment Management Authority (NEMA) who will be able to assist.
  2. Fill out and fill out the application form that can be obtained at the NEMA office, along with the documents required, which are listed under the required documents section of this page.
  3. The licensing officer coordinates with the applicant about the date when inspections will be conducted and on the inspection checklist. Inspections take place from Monday through Friday between 8am and 5pm (excluding the public holidays and weekends).
  4. On the day of inspection, the licensing official examines the affected air, water, or land that is in excess of the standards or guidelines provided in accordance with the checklist for inspection.
  5. If the air, water or land isn’t in compliance with standards for licensing, it automatically is not inspected, therefore the applicant has to schedule a second inspection.
  6. Re-inspection is conducted in the same manner like the initial inspection.
  7. You can only proceed to the next phase of the procedure after having passed the water, land or air passes are inspected.
  8. The process of licensing continues with the next step where the licensing officer reviews applications.
  9. If the chief officer, the permit may be presented for approval by the senior officer. Environmental monitoring committee to be authorized.

The Environmental Monitoring committee shall

  • within 30 days, inform those who could possibly be affected by proposed activities of the applicant, and request them to submit representations;
  • take into consideration the suggestions from the relevant agency in charge;
  • examine the application in relation to all representations that the committee on technical issues received.
  • If they are convinced by the applicant’s documents If the committee for environmental monitoring may approve or deny the request.
  • The license is issued with the Departmental license stamp.
  • Create a copy of the Licence to attach with application and inspection forms to be used for filing
  • A suitable application fee must be paid.
  • After approval and confirmation from the Environmental monitoring committees and other authorities, the license is granted.

Note:

  • When the committee decides to deny the application for the pollution control Licence it must explain in writing the reasons behind the decision to reject.
  • The committee will not give a Pollution Control license until it is convinced that the applicant is able of paying those affected by the pollution and also of removing the pollution in line with the “polluter pays principle” as stipulated in the Environment Act.
  • The Authority must keep a register that includes all pollutant control licences issued by the Pollution Act.
  • The register is an open document that can be examined at any reasonable time by anyone after payment of the fee prescribed.

Fees

The amount to be paid to this Licence UgShs. 250,000/=.

Validity

Valid for the period stipulated in the form of application. It can be renewed for a further time period as stipulated by regulations.

Maximum processing time: 30 working days

Instructions

  • Anyone who pollutes the environment in violation of the Environment Act or any other applicable law is liable for any damage to human health or to the environment, regardless of the cause.
  • Any person who performs or does an omission that can increase the damage or cause of nuisance by pollution earlier is jointly and equally responsible in the cause of the contamination.
  • The person must not undertake any activity likely to pollute environment, land or water over any standard or guidelines imposed or published under the Pollution Act except under and pursuant to the pollution control licence.
  • One who is responsible for the greatest amount of pollution is responsible for the greatest burden of taking care of the environment.

The Information You Need

  • A report on the Environmental Impact Assessment Report.
  • A Health Inspection Report issued by the Town, City or district Council in which the issue of pollution is contemplated.

  • Information on ways to reduce the environmental impact caused by flaring or venting(if appropriate in the case of gases , and in other areas)
  • Information on nuisance or damage resultant from pollution

Information that could be helpful

  • Any information that is proprietary to the committee must be considered to be confidential.
  • The charges will be used to support environmental conservation by charging lower fees to activities that lessen the pollution.
  • In the event of an acute pollution or the risk for acute pollutant, the responsible person must immediately inform the nearest police station, authorities, Authority and the appropriate principal agency according to the procedure prescribed by the Authority.
  • When cleaning-up efforts are being conducted the polluter must keep the Authority as well as the police and the responsible agency updated, and the Authority can provide assistance or seek assistance from the appropriate government department.
