How To Register Design In Germany
- Complete the R5703 request form which is provided from the German Patent and Trade Mark Office. The form is available under the “Documents to Use” section where you can fill out the application form.
- Send your application for consideration to German Patent and Trade Mark Office in Jena. You can make your application in person at office offices located in Munich, Jena and Berlin. Some Patentinformationszentren (patent information centres) accept design applications for transmittal to the German Patent and Trade Mark Office.
- The application fees must be paid.
- When your application is accepted It will be reviewed through the Designs Unit checking the application for any imperfections. It will also check for any defects. Unit will also determine whether the design you’re applying for is eligible for protection under the design or not, and if the design conforms to public policy and accepted guidelines of morality. The design cannot be considered to be the use of any State emblems or other indicators of public importance. If the above requirements are satisfied The Design Unit will enter the design into the Designs Register. Be aware that the Designs Unit does not examine whether the design meets the essential requirements for protection which means that it’s truly unique and distinctive. If there is disputes the requirements are analyzed through the court of law. But, if the requirements have not been in place at the time of the filing – even though the design has been registered the application is not granted, there is no IP right is granted and rights could be earned.
- The design registration will be published in the electronic designs gazette (Geschmackmusterblatt).

- The design is represented in a way that is appropriate for publication. The design representation can be adhered to or printed in this representation format (pdf- File R5703.1) or saved as an JPEG document (*.jpg) onto an electronic storage device (CD or DVD).

- Individual application (including an extension of protection for five year): EUR 70
- Multiple applications (up to 100 designs could be submitted with one form): EUR 7 per design, with a minimum of EUR 70.

Validity
The protection of a design begins when a design is registered into the Designs Register. The protection period can be up to 25 years from the date of filing.
