How To Register Trademark In Germany
- You must fill out the application form. A link is included under “Documents to Use” section that you can click to download the application form.
- Your application for a trade mark must include the following elements:
- Specific information of the applicant,
- A representation that represents the trademark
- A list of products and services.
- It is possible to submit your application in advance via sending a fax (089/2195-4000) at the DPMA. It is important to make sure to send each application or communications separately. It will be simpler to authorities at the Patent and Trademark office to connect your fax documents to the Trade Mark department.
- The German Patent and Trade Mark Office will scrutinize your application to determine whether it is absolute grounds for refusing. Signs or symbols are barred from registration if only they define the nature of product, the quality, or other features of the product or service requested. The Office is not able to determine if similar or similar trade marks have been registered.
- If the application is in compliance with the legal requirements and there isn’t any obstacle to registration then the German Patent and Trade Mark Office will register the trade mark into the registry. It is then published on the internet in Markenblatt (trade trademark journal).
- The trademark owner will be issued the Certificate of Registration.
Note:
A trade mark could be cancelled as a result of an appeal procedure because of earlier trademark rights.

Fees
Minimum cost for Trademark registration fee: EUR 300.– (or EUR 290.- for electronic filing)
Validity
Trademark registrations is able to be renewed for a period of time and can last for the rest of time. When the annual renewal cost has not been paid on a regular basis the registration will be cancelled.
