Apply For Obtain a First Certificate of Title in Dominica

  1. Take all the documents required to be provided and submitted in order for registration of a land.
  2. Before documents are presented to the Registry Office to be processed all fees related to the process must be paid to the Treasury. The fees to be paid include 1% Judicial Fee and the Assurance fee of 1% on the amount that the property is worth. The documents to present for cashier service at Treasury include The Request as well as one form of title.
  3. After all fees have been paid, all the required documents are then presented to the Registry Office by entering documents that include their date and time on the presentation books.
  4. Following the presentation the schedule, a copy of the plan must be made public in two successive issues in any publication published within Dominica to benefit those who be interested in the country and would like to oppose the plan.
  5. A Notification informing the applicant that an application was filed at the Registry Office must be served on the adjoining occupiers (example those who own land that borders the applicant, the North, South boundaries and the like.) This is carried out to notifying the public about the registrationand ensuring that the proposed plan is a correct and accurate representation of the land claimed and the rights of the adjacent occupiers aren’t being restricted. If the occupier next to you has a complaint, the occupier is entitled to put a the Caveat (a legal document that stops from registering) on the proposed application. If the parties concerned cannot settle the issue, then Caveat will be heard by an adjudicator in the chambers.
  6. The advertisement is printed on two copies from the newspaper as well as two copies of the advertisement in the newspaper and an Affidavit of Service (a document that is sworn from the one who served adjoining occupiers) is required at the Registry Office.
  7. When the advertisement has expired for six weeks following the publication of the publication or on the website of the nearby occupiers (whichever is the earlier) The documents are scrutinized for accuracy and then presented to the Judge for his Flat (the decision of the Judge’s Flat is required to authorize).
  8. When you have received the Judge’s Flat has issued, the appropriate stamps and details are inserted on the 2 titles forms as well as the 2 survey plans.   • Supporting documents (i.e. Deeds, Probateand Receipt death certificate, valuation etc.)) which can further establish the rights of the applicant to the property.
  • Abstract of Title (i.e. the list of affidavits and documents supporting it).
  • Schedule (i.e. the title advertisement which is published within the newspapers).
  • Two (2) title forms containing pertinent information about the Applicant as well as the land that is to be registered.

Fees

To register a property applicants must pay a 1% Judicial fee and the Assurance fee, which is 1%, determined by the value of the land that is to be registered.

Instructions

To be able to register a land the first time, an application must be submitted in writing to Registrar of Titles.

Documentation is needed

The Certificate of Title is a document issued following the time a property is registered is in compliance with the Registration of Titles Chapter 56:50 of 1990 and Chapter 56:51 1990 in the Revised Laws of Dominica. The Certificates of Title are issued in duplicate by the Registrar of Titles. They are issued in duplicate by the Registrar of Titles.
