  • To obtain the license to embed power production, you must submit your application for the license to Nigerian Electrical Regulation Commission (NERC). The NERC contact information by clicking the following link: NERC contact details.
  • Download the application form for embedded power generation at the NERC office or download it via the NERC website at this URL: License application form.
  • Fill out the application properly and have it signed by a notary public or a commissioner of swearing. The application form must be filled out in three copies.
  • Create all the necessary documents that support your application in three copies on paper and create an electronic copy of your entire application as an electronic version i.e. the application is made the application is in Microsoft Office software format contained on the CD-ROM.
  • Then , visit the NERC office to pay the processing fee, which is non-refundable, through the NERC cashier, and collect the receipt of payment
  • Send three copies of the application along with one copy in soft form of entire application in CD-ROM at the NERC Official at the service desk , along with the receipt for payment.
  • A NERC officer will review your application and will issue you an acknowledgement receipt containing the details of your application, including the date of its receipt.
  • The commission will then examine the application and all documents submitted to determine if the application is in compliance with the standards established by NERC. If the application is insufficient the commission will send an official notice requesting that you submit the required documents or details for the complete application.
  • After review and if your application is completed as per the requirements within 30 days of receiving the acknowledgement of receipt of your application after review, the NERC will ask you to make a public announcement that will be published in 2 newspapers i.e. one circulating within the proposed zone of operation as well as a newspaper with a national circulation in Nigeria. Notices will be released according to the guidelines set by NERC and should include the time frame within which any representation or objection regarding the application is made in writing to the Commission.
  • Submit a copy of the newspaper’s publications for the Commission.
  • If there isn’t any objections to your application from the public The commission will then deliberate on the request and make a decision to grant the license , or deny the license, based upon the quality of the request.
  • If a decision is made after a decision is made, the commission will inform you by letter not later than six months following the date on which they received your application.
  • If the commission plans to deny the grant of the license the commission will notify you of the reasons behind being unable to grant the license and give you the chance to submit appropriate suggestions in writing to the Commission within twenty-one days from the date of receipt of the notice of refusal sent by the Commission.
  • The Commission will review the claim that you made. If the claim is not successful the commission will inform you in writing that your request for license was rejected.
  • When the Commission has granted the license, the Commission will inform you in writing of the approval along with the conditions that must be met as well as the fees to be paid prior to the granting of the license.
  • Pay the licensing fee in accordance with the number of megawatts required to be produced and, upon payment your license is issued and given to you.

Required Documents For Embedded Power (Electricity) Generation License

  • A completed Application Form.
  • Certificate of Incorporation, Memorandum, as well as Articles of Association or the Deed of Partnership, or Deed of Trust.

  • MOU and/or Letter of Intent with or Letter of Intent Engineering Procurement Contract (EPC) Contractor (if the case).
  • MOU and/or A Letter of Intent signed by the partner technical (if appropriate).
  • Financing Agreements or Letters to finance your project through the financier institution(s).
  • Timings for commissioning of the power plant, as well as the date that the different capabilities of the plant are set to come into operation

A Embedded Generation license enables you to generate electricity which is directly connected and then evacuated through a distribution network or an independent distributor licensee.

Other uses for the document/certificate

The embedded generator is engaged in negotiations for relevant power purchase contracts with electrical distribution licencee (DisCo) or an independent distributor. Embedded generators do not need an agreement for power purchase with NBET or an agreement to connect with TCN.
