Required Documents For Obtain a Travel Agency License

  • Memorandum as well as Articles of Association (MAA).
  • Formula 9. (Certificate for incorporation and formation of a private Corporation)
  • 11. (Notice of Resolution) (Notice of Resolution)
  • For Form 13 (Certificate of Incorporation for the Change of Name of the Company) (if applicable)
  • Formula 24 (Return of allotment shares)
  • Formula 32A (Form of Transfer of Securities) If applicable

  • MyKads (Malaysian citizens) passports (non-Malaysian citizenship) for shareholders as well as members of the members of the Board of Directors.

  • A duplicate of the Certificate of Registration of Company and company licence when the shareholder is a foreign corporation. The copy must be verified through the Malaysia Tourism Promotion Board (Tourism Malaysia) or the Embassy of Malaysia /Office of the High Commissioner of Malaysia in the country of origin.
  • Educational certificates in the area of business or tourism of members of the shareholders/ board of Directors / employees (if there is any).
  • Letter of business collaboration with a an agency for tourism from abroad, when applying for an Outbound license.
  • The draft of the tour packages to be provided in the event of a request for an Inbound/Outbound license.
  • Working paper that includes business planning targets for the number of visitors to Malaysia and short-term revenues for corporations with shareholders that are foreign-owned companies.
  • An extract of the current annual audited financial statement was submitted to and confirmed through the Companies Commission of Malaysia, for companies that were previously licensed through the Ministry of Tourism and Culture however, whose license is expired or was revoked.

Eligibility

  • Private limited company is formed in the Companies Act 1965.
  • In accordance with the paid-up capital and equity limit requirements laid in Appendix (Companies with foreign equity that exceeds 51% equity aren’t allowed to obtain the tourism vehicle license in the case of businesses located in Sabah, Sarawak and the Federal Territory of Labuan).
  • Shareholders must not hold any stake (share capital) or equity in any tourism company authorized under the Tourism Industry Act 1992.
  • Shareholders (foreign company) must have been operating in their country of origin for at least 5 years.
  • Name of business will indicate a business that is engaged in the business of operating tours and the business of a travel agent (travel tours, travel, holiday vacation, adventure etc. ).
  • It is essential that the Memorandum along with the Articles of Association or Form 11 (Notice of Resolution) should specify that the activity is the tour operator business and Travel agency businesses (To be able to conduct business in the tour operating business as well as the travel agent business).
  • No compound is prohibited under the Tourism Industry Act 1992 or the Tourism Vehicles Licensing Act 1999 (Sabah, Sarawak and the Federal Territory of Labuan).

On-line Payment : Online payment: RM100.00 for each application at http://www.spip.gov.my
Payment by manual: RM100.00 by way of postal order/bank draft or money order made payable to PESURUHJAYA PELANCONGAN (Commissioner of Tourism).
