  1. Anyone who wishes to lend money should obtain an money Lending licence at the Uganda Microfinance regulatory Authority (UMRA) by providing its incorporation documents as well as the names of directors and secretary, and paying the required fee.
  2. The applicant should submit an application using the form 1 and submit it to the Uganda Microfinance Regulator Authority, attaching all necessary documents.An application should be with the following requirements that are:

    • If convinced that directors and managing of the company are able to continue the business of lending money and issue a notice that there is no objection to the changes in directors and management
  5. The Authority will review an application and notify applicants of their decision in three months of the date the application is lodged with it. However, in the event that the Authority wants to know more, the time period of three months will be calculated starting from the point the additional information is provided by the Authority.
  6. The Authority could, upon a valid application submitted and after having been provided with the information it may require, issue an authorization or deny the application.
  7. When deciding whether to grant an authorization or deny an application, the Authority will consider the qualifications and morality of any person employed or is employed or in connection with the applicant with the intention of conducting the business of lending money.

Eligibility

  • Anyone is able to start any Business of Money lending in Uganda
  • The application permits a person to manage an establishment that lends money in Uganda.
  • In Uganda nobody is allowed to be operating a Money Lending Business in Uganda unless approved from the Uganda Microfinance regulatory Authority

Validity

The license issued to the loan lender’s name is in effect for the 31st December of each year. It is also possible to renew each year.

Instructions

  • This licence is not transferable , assignable or transferable.
  • The Licensee must not operate the business of money lending under multiple names.
  • Licensee must surrender the license when it is requested from the Authority.
  • After being issued, the license is required to be displayed at any location where the money lender conducts its business in the field of money lending.
  • A money lender should not alter its management unless it has the written authorization by the Authority.
  • The licensee is required to provide written notice to the Authority upon the occurrence or modification of any event that could affect or affect in any way the subject matter to which the licensee given or has been required to provide details to the Authority during the process of applying for the license.

Information that could be helpful

  • The Regulations stipulate that money lenders must maintain a physical address as well as keep and archive records pertaining with their businesses for a time which is between 10 and 10 years.
  • Money lenders must show interest rates always in a prominent place on their premises. They must also keep accurate books of account, such as an account of the securities and debtors.
  • UMRA is also required to maintain an inventory of all lenders who can be examined by people who are interested at cost.
  • The Regulations stipulate that UMRA to assess the suitability and ethics of the board and management of a lender of money and of anyone who is going to be employed by or affiliated with the money lender.
  • Any change in directorship or management of a money lender has to be approved by UMRA.
  • The Regulations stipulate that a lender is not allowed to solicit the following documents to be used as collateral to secure money advances documents: passports, IDs, ATM card or security code for ATM cards, deposits account books, or any other document of transfer of assets or property that is signed prior to the disbursement for the loan.
  • Additionally, if an alleged money loan transaction appears to be a transfer or sale of property, that transaction is subject to nullification by the court and could cause the revocation of the license granted to the money lender.
  • A money lender can’t remove collateral unless 60 days have passed after an order for payment was served on the person who borrowed the money.
  • A money lender is under the obligation of selling the collateral at a price not less than the forced sale value , unless incapable of doing so within the initial two attempts at the sale.
  • The Regulations also permit the payment of a waterfall on the sale of collateral that is similar to the waterfalls prescribed for the foreclosure of mortgage-backed land.
  • The Regulations state that borrowers can pay any amount in repayment to UMRA in the event that the money lender is unwilling to accept the payment or when it is not feasible for the borrower the money lender to pay the amount.
  • This will hopefully end the issue of lenders who make it difficult to repay of loans by the borrower to earn additional interest or to sell collateral of the borrower.

  • A more efficient and well-structured money lending system will no doubt provide a safer and more favourable environment for money lending professionals to conduct their profession and for the borrowers to access credit. But, since money lending is designed to provide loans that are affordable to the poorest segment of the population to provide an alternative to traditional institutional credit, it’s essential to achieve the perfect equilibrium between creating a safe and secure environment for money lending , and restricting untrustworthy and shady methods of money lending. Regulations that are too strict could be detrimental because it can make it more expensive credit, rendering businesses uncompetitive and leading to non-compliance by money lenders.
  • Although the adoption of the Regulations is an encouraging development however, it is yet to be determined if the government has invested the money and developed the necessary structures to follow the implementation of the Regulations and the Act. Uganda isn’t deficient in good law. The danger is always in their implementation.
