  1. A permit for private primary school is available from the Ministry of Education and sports as per the Education Act of 2008. Act of 2008.
  2. The intending proprietor should collect forms for licensing a private primary school from MoES HQ/district/Municipal Education Office and fills them in triplicate following requirements as listed below.
    • A recognizable proprietor. He/she must be an individual or organization with a good reputation, without a criminal record , and have the funds required to run the type of institution to be created.
    • A prospective owner must obtain letters of recommendation by LCI, LCIII and opinion/religious leader.
    • The proposed school or institute must be conforming to the District or Municipal Education Plan and be in accordance with the updated Education Sector Strategic Plan.
    • Documentation of ownership or lease for the land where the school/institution will be located, or an agreement for tenancy that is valid for at minimum (5) five years to be used for secondary schools and eight years for elementary schools (in the case of buildings that are hired)
    • It must have been designed and built to serve the needs of a school.
    • There should be enough space to expand playgrounds, expansion as well as school gardens as well as physical education (urban schools could be considered exceptional situations).
    • It is necessary to have an approved development plan specifically for the license period and evidence that 10 percent of the plan’s funds are in place.
  3. Once these are in place, the owner of the business is able to write to MoES’s Permanent Secretary (PS/ES), MoES, to explain his intentions and asking for advice.
  4. The application form must be filled out according to the guidelines of the Ministry of Education and sports and it must be accepted from the District Education Officer (DEO)
  5. The owner seeks to have an inspection of the institution or school through DIS/MIS and the D/MHI to determine if the school is in compliance with the standards that are set forth within Section 31 in the Education – (Pre-Primary, Primary and Post-Primary) Act 2008.
  6. The District/Municipal Superintendents of schools (D/MIS) along with District/Municipal health inspectors (D/MHI) following inspections prepare detailed inspection reports and then endorse the forms for application and forward the application to DEO/MEO for approval. forms as well.
  7. The District/Municipal Education Officer forwards (3) three copies of the forms for application and all supporting documents required in (3) three folders for the PS/ES (in the case for post-primary) and the CAO/Town Clerk (in the case of primary).
  8. The PS/ES (in the case for post-primary) or the CAO/Town Clerk (in the case of primary) in reliance on recommendations or reports from the district, or a report based on a physical inspection by the inspectors decides whether or not to approve the license application.
  9. The Town Clerk/PS/ES/CAO/Town Secretary when approved, issues an operational license for the school/institution that will last two (2) the school’s two years, as per Section 32(1) of the Education-(Pre Primary, Primary and Post-Primary)Act 2008. Copies of the licence are delivered to the Director for Directorate of Education Standards, District/Municipal Education Officer and District Municipal Superintendent of Schools.
  10. MoES/DEO/MEO keeps one file; the second one is for the DEO (in the case for post primary) and the final file will be for school. The owner ensures that the school gets an exact copy.
  11. Six months prior to the expiration of the two-year license, the owner collects at the MoES (Headquarter) District/Municipal Education Offices , a form for registration.
  12. In the event that the school is not eligible to be registered, the owner must submit a request for renewal within one month from the expiration date of the license. It is granted only once. License renewals are for only one year. If, at the end of the year in which renewal was granted, the owner is not in a position to officially register the school and close the school in a short time by PS/ES.
  13. All new institutions or schools should be established in the middle of each academic calendar year, as stipulated in the school/institutions calendar, which is released from time date from the Ministry of Education and Sports. Application for licensure schools like Primary, Pre-Primary as well as Secondary Schools, must be made to the Town Clerk/PS/ES/CAO beginning in June. Licenses will be issued before the 30th December , which means that schools can be opened at the beginning of January, or in the month of February in the previous year.
  14. The owner is required to provide an original copy of the occupation permits for the school buildings.

Required Documents For Obtain a Licence to Operate a Private Primary School

The owner who wants to run a primary school must meet the following requirements.

  1. A qualified Head teacher who is not below Grade Teaching Certificate for primary education. They must also have a valid registration at the Ministry of Education and Sports.
  2. A list of all teachers who are registered and/or licensed by the Ministry of Education and Sports.
  3. Documents containing financial and administrative documents.
  4. A bank account at school.
  5. Key statutory documents(e.g.Constitution of the Republic of Uganda(1995)
  • Functional School Management Committee(SMC),constituted in accordance with the SMC Guidelines and Education-(Pre-Primary ,Primary and Post-Primary)Act 2008 and must be approved by DEO.
  1. A minimum of one teacher is housed on or close to the campus of the school.
  2. At minimum five acres in a secure and safe area. (Urban zones may receive particular attention) but the classroom size(floor area)should never be less than 5.8m across 8.8m (51.04 m2)or 5.8m across 7.8m (45.24 m2)).
  3. Security arrangements that are properly implemented (in conformity with the Basic Requirements and the Minimum Standards as stipulated within the Disaster reduction and risk management guidelines of the Directorate of Standards for Education, Ministry of Education and Sport).
  4. First Aid kits.
  5. A minimum enrollment of no more than 40 students per class, per teacher.
  6. The appropriate seating facilities are needed for students.
  7. Drinking water that is safe to drink.
  8. One pit latrine stance or toilet(squatting/Asian type preferred) for every 40 pupils by sex.
